GENERAL CONDITIONS OF PARTICIPATION IN ESPORT COMPETITIONS

ARTICLE 1. CO-ORGANIZERS

The company Orange MEA, whose registered office is located at Tour Casa Finance City, LOT 57, 17e etage, quartier Casa-Anfa, Hay Hassani, Casablanca, RCS RC Casablanca n° 418131 (hereinafter, the "Co- Organizer") and the company Gozulting, whose registered office is located at 18 rue Soleillet 75020 Paris, RCS Paris n° 830 489 902 (hereinafter, the "Co-Organizer") organize video game competitions called " Orange Esport Experience ", mainly online, in which various eSport tournaments are organized (hereinafter, the "Tournaments") and for which participation requires prior registration on the website https://esport-experience-orange.com, published by Orange MEA, by creating a player account in accordance with the provisions of its Terms of Use (hereinafter, the "TOU") (hereinafter referred to together as the "Services").

ARTICLE 2. ACCEPTANCE OF THE GENERAL TERMS OF PARTICIPATION

By registering for a Tournament, you accept, without reservation, all of the present General Terms of Participation (hereinafter, the "GTP") which are intended to define the conditions under which you register for a Tournament and you declare that you are entitled to accept the present, or if you are a minor under 15 years of age, that you are authorized to do so by your legal representative, and you guarantee the Co-Organizers of this fact. As such, this authorization may be required for certain tournaments.

ARTICLE 3. MODIFICATION OF THE GENERAL CONDITIONS OF PARTICIPATION

The applicable general conditions of participation are those in force at the date of your connection and use of the website https://esport-experience-orange.com

The Co-Organizers reserve the right to modify the present General Conditions of Participation, at any time, in whole or in part, without prior notice or information, without their liability being incurred in this respect.

Any changes made by the Co-Organizers to these general conditions of participation will be brought to the attention of and accepted by Users via a dedicated pop-up when they connect to the website. You will be required to accept them to continue to use the Services and participate in the Tournaments.

ARTICLE 4. ACCESS TO THE SERVICES

The website https://esport-experience-orange.com and the associated Services are in principle available continuously, except in case of interruption, scheduled or not, or to ensure their maintenance, or in case of interruption by force majeure. The Co-Organizers shall not be held responsible for any damage or interruption, whether partial or total, of any nature whatsoever, resulting from the unavailability, even partial, of the aforementioned website and the associated Services.

ARTICLE 5. REGISTRATION FOR TOURNAMENTS

The offer of the Tournaments for which you can register is available on the website https://esport-experience-orange.com.

For each competition and for each Tournament offered, the Co-Organizers define the number of places available per Tournament and the Co-Organizers can, in addition, define the eligibility conditions that must be fulfilled in order to validate one's registration for the Tournament.

To register for a Tournament, you must have the video game, an internet connection, and a player account (created when you register on the site https://esport-experience-orange.com) and fill in the various information required on the registration page of the Tournament in which you wish to participate mentioned in article 12 of these GTC. In accordance with Article L321-11 of the Code of Homeland Security, you are informed that the cost of access to the Internet and the possible cost of acquiring the video game used to support the competition do not constitute a financial sacrifice within the meaning of Article L. 320-1 of the Code of Homeland Security.

Once you have registered for a Tournament, an administrator will be responsible for accepting or refusing your participation in the Tournament and the decision taken by the administrator will be notified to you by email at the address associated with your player account.

The registration to the Tournament becomes final only once validated by the Co-Organizers. The Co-Organizers remain free to refuse any registration to the Tournament, for legitimate reasons and in particular in case of non-compliance with the eligibility criteria or unavailability of places in the Tournament.

ARTICLE 6. ACCEPTANCE OF THE TOURNAMENT RULES

Registration for a Tournament implies full acceptance of the rules of the Tournament for which you have registered (the "Rules"). By participating in a Tournament, you agree to the specific provisions of the Rules. The Rules define the conditions under which the Tournament will take place according to the nature of the video game and the associated technical constraints. The Rules may also include specific rules regarding the eligibility requirements or the number of places available for each Tournament. The Rules are freely available for consultation on the Tournament registration page and on the website https://esport-experience-orange.com.

ARTICLE 7. PRIZES

The Tournaments may provide certain prizes depending on the performances achieved. The prizes, their distribution, their amount as well as the methods of sending them are indicated in the Rules of the Tournament in which you register.

ARTICLE 8. RULES OF CONDUCT

The Co-Organizers encourage all participants to behave in a fair, honest and respectful manner towards other participants. When participating in the Tournament, you must comply with the applicable laws and regulations of the country in which you reside, but you must also comply with additional rules of conduct that govern your participation in the Tournament (specified within the Tournament rules).

These rules of conduct are intended to provide a non-exhaustive list of prohibited conduct and dishonest practices that may result in an undue, unnatural and unpredictable advantage. The Co-Organizers reserve the right to modify these rules of conduct at any time and to take any appropriate disciplinary action in the event of non-compliance with the rules of conduct, whether or not the behavior is listed below. The following behaviors are subject to sanction:

  • Refusing to follow the instructions of the Tournament Administrator ;
  • Arrive late to the Tournament at the appointed time;
  • Choosing a pseudonym or posting content that indicates a false association with the Co-Organizers that is vulgar, obscene, offensive, illegal or infringes on the rights of any third party;
  • Harass, stalk, threaten, intimidate, or otherwise engage in conduct that is harmful to other participants or the Tournament Administrator;
  • Communicate any content that could be considered offensive, including illegal, insulting, abusive, obscene, sexual, racist, defamatory, or racially, politically or religiously biased content, or any other content that is unethical, unsportsmanlike, or otherwise objectionable under applicable law or regulation;
  • Publish commercial content advertising or promotional or damaging to the reputation or image of Co-0rganizers;
  • Create multiple player accounts;
  • Register for the Tournament via the player account of a third person to play one or more games in place of the account owner;
  • Create a false identity or impersonate another person;
  • Publish personal information of other participants (such as name, surname, address, phone number, etc.) on a publicly accessible space, be it social networks, on a website or by any other means;
  • Knowingly use or exploit a bug in the video game to gain an unfair advantage, whether or not defined in the Tournament Rules;
  • Fraudulently access or maintain access to all or part of the automated data processing systems;
  • Use third-party cheating software that alters the game's functionality, rules, data or graphics;
  • Tampering with or interfering with the operation of an automated data processing system, whether it be the video game or the Services;
  • Transmit or facilitate the transmission of computer viruses, corrupted data or any other means intended to hinder the operation of an automated data system;
  • Not notifying the Co-Organizers of the existence of a bug or loophole that would allow them to gain an unfair advantage during a game;
  • Not using best efforts to try to win a match;
  • Betting or setting up an illegal betting system on the Tournaments;
  • Manipulating the ranking of a Tournament.

The Co-Organizers reserve the right to sanction any participant who engages in any prohibited or harmful behavior, whether or not listed. You may report any such behavior or harmful content by written request sent by mail to Orange MEA, Tour Casa Finance City, LOT 57, 17e etage, quartier Casa-Anfa, Hay Hassani, Casablanca.

Orange MEA also declares that it is a member of the ESIC (Esport Integrity Commission) and as such adheres to the defense of an honest practice of eSport, this commitment being expressed in the ESIC codes available hereafter: https://esic.gg/code/. By participating in a Tournament, you commit yourself to respect the provisions of the codes applicable to the players and teams eSport. A version in French of the codes could be communicated to you, by simple written request sent to contact@esport-experience-orange.com

ARTICLE 9. PARTICIPATION OF MINORS IN COMPETITIONS AND TOURNAMENTS

Participation of minors under 12 years old

In application of the article R321-44 of the Code of the internal security, the participation of a child of less than 12 years in competitions of video games offering monetary rewards is forbidden.

For competitions that do not offer monetary rewards, a written parental authorization is required. This parental authorization must be accompanied by a valid ID (national ID card, passport) of the legal representative(s) and of the minor, in accordance with the provisions of article R321-43 of the French Internal Security Code.

Participation of minors over 12 years of age

The participation of minors over 12 years of age in video game competitions offering monetary rewards is subject to a written parental authorization, under the conditions provided for in article R321-43 of the French Code of Internal Security. This parental authorization must be accompanied by a valid identity document (national identity card, passport) of the legal representative(s) and of the minor.

ARTICLE 10. APPLICABLE SANCTIONS

In case of violation of the present rules or of the Tournament rules in which you participate, the Co-Organizers reserve the right to impose a certain number of sanctions according to the seriousness of the breach. The following is a non-exhaustive list of sanctions that may be imposed by the Co-Organizers, depending on the good faith of the participant and the seriousness of the infraction:

  • Warning
  • Loss of a round
  • Loss of a match
  • Disqualification

Depending on the degree, the gravity and the possible repetition of the violation, the Co- Organizers may decide to apply additional sanctions such as banning from future Tournaments or Competitions, or the suppression of prizes.

The Co-Organizers may also decide to impose additional sanctions specific to the parameters, characteristics, and rules of the video game on which the Tournament is being played. Notwithstanding the foregoing, the Co-Organizers reserve the right to take legal action against any participant, both civil and criminal, depending on the nature and gravity of the damage observed.

ARTICLE 11. LIMITATION OF LIABILITY

You acknowledge that the Online Services required for your registration for the Tournament are provided "as is" without warranty of any kind and that your use of them is at your sole risk. The Co-Organizers cannot guarantee that the Services will be uninterrupted or free of defects, that defects will be corrected, that the Services will be free of viruses and cannot be held responsible in any way for the partial or permanent interruption of the Services. It is the responsibility of each user to take all necessary precautionary measures to protect their data from possible computer attacks.

Throughout the Tournament, you acknowledge that participants are entirely responsible for their own behavior and the Co-Organizers cannot be held responsible for any direct or indirect damage resulting from a participant's misconduct. Likewise, the Co-Organizers cannot be held responsible for any direct or indirect damage to the participant resulting from a technical problem with the game or the participant's Internet connection.

You are warned of the risks inherent in the intensive practice of video games and, as such, the Co-Organizers decline all responsibility in case of direct or indirect damage resulting from such practice.

The Co-Organizers will not be liable for any damage suffered by the participant during the Tournament, except in the case of a serious breach of a safety obligation or in the case of gross negligence. Gross negligence is defined as any action or omission to take or cause to be taken measures that would, without risk, prevent a loss that would endanger the safety of persons. The liability of the Co-Organizers is limited to direct material damages, excluding any indirect or immaterial damages, including but not limited to loss or damage to participants' accounts, computer failure or malfunction, any loss of profit, operating loss, or any other loss of revenue, damage to reputation, goodwill or image suffered by the participant. In any case, the responsibility of the Co-Organizers is strictly limited to the delivery of the information necessary to participate in the Tournament.

ARTICLE 12. PERSONAL DATA

For each Tournament, Orange MEA and its partners use the data contained in your player account. In order to complete this data, Orange MEA also asks you to fill in additional mandatory or optional information about you and / or related to the video game subject of the Tournament (game account, nickname, etc..), which you certify accurate.

All this information is necessary to Orange MEA for various purposes including :

  • Registration and management of your participation in the Tournament;
  • The awarding of any prizes that you could have won by participating in the Tournament;
  • The verification by Orange MEA of your compliance with the general conditions of participation;
  • The establishment of statistics.

Failure to provide this information will result in your registration for the Tournament not being completed in the case of mandatory information. The declaration of erroneous information can lead to the cancellation of your registration and, if necessary, the disqualification or cancellation of your performance in the Tournament.

The information presented as optional allows Orange MEA to evolve the offer and the site in order to guarantee you a better gaming experience.

You are informed that if you are under 15 years of age or if you are considered a minor within the meaning of the General Data Protection Regulation (Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016), you must obtain the consent of the holder of parental authority for the processing of your personal data. This consent may be given by any appropriate means and in particular in the context of the application of Article 9 of the GTC.

You are informed that some data about you may appear publicly or be made public by Orange MEA to allow the smooth running of the Tournament. This data includes your game account, your nickname, details of your level of play associated with your game account, your account on third party communication software or any other information deemed necessary by the Co-organizers.

This data may also be used for commercial solicitation purposes if you have expressed your wish by checking the corresponding box.

In order to provide you with the best possible user experience and for security reasons, the data you provide will be kept by Orange MEA for a period of one year from your last use of the Services.

As an exception to the above, in certain specific cases (such as winning a prize), the data you send us may be archived for a maximum of 5 years for the purpose of processing any complaints.

All information provided may be transmitted to any competent authorities or organizations as well as to subcontractors of Orange MEA for internal processing purposes on its exclusive behalf.

In accordance with the Data Protection Act No. 78-17 as amended and Regulation 2016/679 of the European Parliament and of the Council of 27 April 2016, participants have a right to limit the processing of their data, a right of opposition, access, portability, rectification and deletion of personal data concerning them, which you can exercise upon written request sent to: contact@esport-experience-orange.com

ARTICLE 13. INTELLECTUAL PROPERTY

The site https://esport-experience-orange.com and each of the elements that make it up (such as logos, brands, images, texts, videos, etc.) are protected throughout the world under intellectual property law, under the conditions of articles 5 and 6 of the GCU. In addition, the participants in a Tournament recognize that the elements composing the video game object of the competition are also protected by the rights of the intellectual property and that no use, reproduction, exploitation, or representation on any support whatsoever is authorized.

ARTICLE 14. APPLICABLE LAW

The present General Conditions of Participation are subject to French law. In the event of a dispute, the French courts have exclusive jurisdiction, subject to any legislative or regulatory provisions to the contrary, as well as any prior disciplinary procedures put in place by ESIC. If one or more of the stipulations herein are declared invalid or declared as such in application of a law or regulation or following a court decision that has become final, the other stipulations will remain in force.
